President Arif Alvi has again approached the Supreme Court in reference to Justice Qazi Faiz Issa.
According to a private TV report, petitions have also been filed by the Prime Minister, Law Minister, Home Adviser and FBR. A new petition has been filed by the President to re-hear the petitions. Justice Faiz Issa has been made a party in the 70-page petition filed under the authority.
It may be recalled that in April, a ten-member bench of the Supreme Court had allowed appeals against its own judge Justice Faiz Issa for reviewing the court's decision on the presidential reference and legal proceedings in all forums, including the Federal Board of Revenue. Was declared null and void.
In a presidential reference decision against Justice Qazi Faiz Issa in June last year, the court had directed the FBR to look into the property and tax matters of his wife Serena Issa and submit its report to the Registrar of the Supreme Court. Apart from Serena Issa, wife of Justice Qazi Faiz Issa, the Supreme Court Bar Association, Sindh Bar Council and Federal Union of Journalists had also filed appeals against the decision.
Appeals for review against the order in the Presidential Reference decision were accepted by a majority of six out of four. Justice Omar Ata Bandial, who presided over the 10-member bench hearing the case, also gave a brief verdict. He said that the report prepared by the FBR could not be used in any judicial forum including the Supreme Judicial Council. In the June 2020 decision, a majority of the ten-member bench of the Supreme Court had quashed the presidential reference against Justice Qazi Faiz Issa. Of these, seven judges had ordered that the case of Justice Faiz Issa's wife and their children be referred to the FBR.
