The Lahore High Court (LHC) has suspended the order of the Sessions Court to register a case against national cricket team captain Babar Azam and has sought a written reply from the concerned SHO as well as Hamza Mukhtar.
According to details, Justice Asjad Javed Gharal of Lahore High Court heard the petition of Babar Azam in which the orders of the lower court were challenged on the application of registration of case. Haris Azmat, counsel for national cricket team captain Babar Azam, pointed out that the Sessions Court had ordered registration of a case against Babar Azam contrary to the facts and Hamza Mukhtar had filed a baseless petition to blackmail Babar Azam.
The lawyer said that the woman had made peace with Babar Azam in 2018 and the matter was over. Police also filed a negative report on Hamza Mukhtar's claim of receiving threatening calls but the Sessions Court ordered to register a case against Babar Azam without evidence.
Advocate Haris Azmat requested that the execution of the order of registration of case against Babar Azam be stopped and the process of registration of case against the captain of the national cricket team be declared null and void. The court granted the plea of Babar Azam's lawyer and suspended the Sessions Court's order to register the case. The court issued notice to the concerned SHO along with Hamza Mukhtar and sought a written reply at the next hearing.
It may be recalled that the Lahore Sessions Court had yesterday ordered the Naseerabad police to record the statement of the woman under section 154 of the Criminal Code of Conduct against Pakistan cricket captain Babar Azam and take action as per law. Additional District and Sessions Judge Muhammad Naeem, while dealing with the petition filed by Hamza Mukhtar, observed that the accused had been charged with serious offenses such as abortion and false assurance of marriage. The Commission was formed on the basis of a punishable offense.
The judge directed the Naseerabad station house officer to record the woman's statement under section 154 of the Criminal Code of Conduct and proceed strictly in accordance with the law. The judge also observed that the police report was inconsistent with the facts of the application. Is different In the petition, Ms. Hamza Mukhtar accused Azam of making false promises of marriage while maintaining sexual relations. She also alleged that she became pregnant with Babar Azam's child in 2015 but had to have an abortion. ۔
